About STDs

STD係指統一英譯法律關鍵詞典(Standard Translation Dictionary),其目標為統一各國的法律關鍵字,研究原因在於一關鍵字在各國會有不同拼法,例如:台灣將「親權」翻做 「parental right and authority」、日本翻為「parental authority」、大陸則翻成「parental obligation」,若各國關鍵字未統一,將台灣的法律關鍵字去查詢他國法律, 恐查無所獲。又若無STD之研究,亦無法妥善利用KWIC來查詢法規,因此STD的重要性不言而喻。

本團隊參照日本及韓國官方出版之統一英譯辭典(SBD),纂我國法律關鍵字之日文及英文SBD,一則可藉此增進日、韓、台KWIC 之連結對照功能,另一則改善我國法律英譯關鍵字詞分歧的問題。 且將結合資訊科技與法律英譯校對之成果,以精進我國統一日譯及英譯法律關鍵詞典。並將定期邀請專家學者共同進行日文關鍵字與英文翻譯關鍵字之校對並召開關鍵字統一翻譯諮詢會議, 以連結對照日本、韓國及香港官方公布之中英文法律關鍵字詞辭典。

Taiwan STD/SBD

Taiwan SBD為我國自行整合現有資源,共納入日本 SBD、台灣司法院SBD、我國法律關鍵字、輔仁大學法律關鍵字等資料。以中文關鍵字為主軸,再納入中日對譯、中英對譯。 Taiwan SBD 分類:截至目前已整理現有國內外資源並編製Taiwan SBD,共計19,423個關鍵字,並以關鍵字來源來做分類,其內容包括:

第一類:日本法務部STD(JP-SBD):將日本官方STD中之3,868漢字翻譯為中文,以對照使用其英譯關鍵字,共計3,868字日英中關鍵字。

第二類:司法院STD(JYsbd):修正司法院彙整並公布於官網之各處室之中譯英關鍵字詞,共2,193個中英關鍵字。

第三類:司法智識庫關鍵字(JYwisdom):納入司法智識庫中文關鍵詞對照找出之英文關鍵字,共4,571個必配對翻譯為中文。

第四類:法律檢選關鍵字(TWlaw):以人工尋找KWIC 法律之中英對照關鍵字,以補充前三項關鍵字來源之不足,目前共計9,853個中文關鍵字。

第五類:輔仁大學(FJULaw) : 與輔仁大學合作,將其常用法學英文字彙表匯入Taiwan SBD整合在一起, 共計1,767中英關鍵字。

第六類:學術關鍵字(TW SBD - Accademic) : 以人工以及資訊科技的方式,進行挑選Academic關鍵字挑選,挑選的來源(全國碩博士論文法律學類、 台大法學論叢、中研院法學期刊、政大法學評論、中正大學法學集刊、台北大學論叢、東吳法律學報、東海大學法學研究、公平交易季刊、中原財經法學。目前收集部分台大法學論叢之關鍵字,共計451中英關鍵字。

A CJKT (China, Japan, Korea and Taiwan) cross-border research group has been developing a multi-lingual legal terminology (12,000 entries) covering the four jurisdictions in East Asia. The sharing of legal terminologies is important in itself and it may lead to a joint academic work to achieve a deeper mutual understanding of law and society in East Asia. This research teamwork has been developing a CJKT Standard Translation Dictionary (STD) since 2011. It is interesting to see how the four jurisdictions share the same Chinese characters (Kanji) in legal terminologies, which denote to different contextual meanings in local societies. It may also be a new experience to see how to identify the “equivalent” terms in four jurisdictions, as well as to compare four legal systems, to discover the uniquness and similarity of laws and procedures, and to develop more realistic view of laws and societies in East Asia.

Take the study of 親権\親權, a common term of the family law of East Asia, for instance, though four jurisdictions share the same Chinese characters, the notion is translated into different English terms. Japan and Korea translates it as “parental authority” but Taiwan and Mainalnd China translate it as “parental rights and duties\obligcations.” Through discussions of the CJKT research team, we noticed remarkable differences in terms of law and society studies on親権\親權. It may identify some important tasks of cross-border collaboration and discuss a method for comparative study. The collaborative work of SBDs (together with LawPacks) aim to clarify the unspoken assumptions of each jurisdiction so that many legal terms can be understood in the real social context of each jurisdiction.
